What a Will Does Under Texas Law
A last will and testament is the foundation of most estate plans. Under Texas Estates Code Section 251.051, a valid attested will must be written, signed by the testator, and witnessed by at least two credible individuals who are 14 or older and who sign in the testator’s presence. Texas also recognizes holographic wills under Section 251.052, which must be written entirely in the testator’s own handwriting and require no witnesses. Adding a self-proving affidavit under Section 251.104 allows the will to be admitted to probate without calling witnesses to testify.
Beyond transferring property, a will is the proper place to name a guardian for minor children and to appoint an executor, the person responsible for administering your estate. Without a valid will, Texas intestacy law determines how your assets are distributed, and the probate court appoints an administrator, which may not reflect your intentions. Probate matters in Montgomery County are handled by Probate Court No. 1, the county’s only statutory probate court, with jurisdiction over probate, guardianship, and related civil matters.
How Trusts Work & When They Make Sense
A trust is a legal arrangement in which a trustee manages assets on behalf of named beneficiaries. Trusts can be created during your lifetime (living or inter vivos trusts) or established within your will (testamentary trusts). The two most common forms are the revocable living trust, which you can modify or revoke at any time during your life, and the irrevocable trust, which generally can’t be changed once signed. Assets properly held in a living trust can pass directly to your beneficiaries without going through the probate process, which can save time and maintain privacy for your family.
